TITLE IX RHODE ISLAND TIMELINE

There have been a number of developments in two complaints filed by the Law Centre at the RI Center for Freedom & Prosperity against the RI Department of Education (RIDE) and its Commissioner, Angelica Infante-Green.

In the RI Superior Court complaint, a pre-hearing conference was held last week with Judge Joseph McBurney, Greg Piccirilli (Law Centre attorney for plaintiff Jane Doe), and attorneys for RIDE.

The complaint seeks repeal of RIDE’s regulations, adopted by the Council on Elementary and Secondary Education – a mandate that by July 1, 2018, each local education agency (LEA) must implement policies protecting transgender and gender non-conforming students.

The Law Centre at the RI Center for Freedom & Prosperity filed a complaint in Rhode Island Superior Court against Angelica Infante-Green in her capacity as Commissioner of the Rhode Island Department of Education, seeking to strike down the Commissioner’s 2018 Regulation 200-RICR-30-10-1, dealing with gender identity.

In a major victory for advocates seeking to protect women’s K-12 sports in the Ocean State, the Rhode Island Interscholastic League (RIIL), under threat of legal action and public pressure, has radically altered its rules and regulations that allow biological boys to compete in girls’ K-12 sports.

The Rhode Island Center for Freedom & Prosperity sent a letter to the Westerly Public Schools Superintendent and School Committee, addressing compliance with new federal policies on sex-based discrimination. The letter cites an Executive Order from President Trump, which mandates federal agencies to enforce sex-based protections under Title IX strictly. The letter urges the school district to align its policies with this new framework to avoid potential litigation and the risk of losing federal funding.

The Law Centre at Rhode Island Center for Freedom & Prosperity has submitted a request to the Office for Civil Rights (OCR) to investigate alleged violations of Title IX by several Rhode Island education entities, including the Commissioner of Education, specific school districts, the Rhode Island Interscholastic League, and the Rhode Island Attorney General.

In late February, we launched the Protect Girls’ Sports petition to urge the Rhode Island Interscholastic League (RIIL) to comply with federal Title IX laws and repeal its policy allowing biological boys to compete in girls’ sports. This policy undermines fairness, threatens the safety of female athletes, and disregards both biological and legal realities.

Gregory Piccirilli, on behalf of the Rhode Island Center for Freedom & Prosperity, submitted a petition to protect IX but has not received confirmation from the Rhode Island Department of Education (RIDE). Instead, RIDE publicly dismissed the petition’s arguments in a news article before formally acknowledging its receipt, raising concerns about the agency’s impartiality and adherence to legal procedural requirements.

The Law Centre at the RI Center for Freedom & Prosperity today published a legal letter and filed an official request with the Rhode Island Department of Education (RIDE) requesting that it repeal its 2018 Transgender Regulation.
